    ACCEPTANCE OF THE TERMS OF USE

    MadloveFit Meals, Foodgasm LLC dba Latin House reserves the right to change or modify these Terms at any time and at our own discretion. If we make changes to these Terms, we will provide notice by updating the “Last Updated” date at the beginning of these Terms.

    These terms and conditions, together with any documents they expressly incorporate by reference (collectively, “Terms of Use”), are entered into by and between MadloveFit Meals, Foodgasm LLC dba Latin House, together with its affiliated companies (collectively, “Company,” “we,” or “us”), and you personally, together with any entity that is accessing or using the Website at your direction or on your behalf (collectively, “You”).
    These Terms of Use govern all access to and use of madlovefit.com, including any content, functionality, and services offered on or through madlovefit.com as well as any other media form, media channel, mobile website, or mobile application related or connected thereto (collectively, the “Website”), whether such access or use is as a guest or as a registered user.

    Please read these Terms of Use carefully before You start to use the Website. By using the Website or by clicking to accept or agree to the Terms of Use when this option is made available to You, You accept and agree to be bound and abide by these Terms of Use and our Privacy Policy, found at madlovefit.com/terms, incorporated herein by reference. If You do not want to agree to these Terms of Use or the Privacy Policy, You must not access or use the Website.

    AGE RESTRICTION

    This Website is offered and available to users who are 18 years of age or older and who reside in the United States. By using this Website, You represent and warrant that You are of legal age to form a binding contract with the Company and meet all of the foregoing eligibility requirements. If You are using this Website on behalf of an entity, You further represent and warrant that You are duly authorized by such entity to form a binding contract between it and the Company. If You do not meet all of these requirements, You must not access or use the Website.

    DELIVERY SCHEDULE

    Deliveries are done every Monday & Wednesday between 8:30am-12pm. We cannot guarantee a specific delivery time, however we will try our best to accommodate a requested time if needed.

    If a delivery is attempted and we are unable to gain access to the facility or community and we had multiple attempts to contact you or if you have provided us with an incorrect address, we will not issue a refund nor replace those meals.

    Please be sure to provide us with security codes, gate codes and any special instructions if you have not already done so. If you live in a gated community, please make sure your guard gate, receptionist/doorman, or security guard is aware that MadloveFit Meals will be delivering to you twice per week for a more diligent and timeful delivery. Special delivery instructions can be added to the order during checkout or you can text your MadloveFit representative to add notes to your order if you require special instructions that would be useful to our drivers.

    Due to the safety of our staff and customers, we offer a no-contact delivery option. The driver will text/call you upon their arrival. Your meals will be delivered in a MadloveFit insulated bag & ice, in order to preserve the quality of the food. Please make sure the bag is left outside for the following delivery in order to avoid a $15 surcharge to your account to cover the replacement. We will be sending out friendly reminders the day prior, however we would also suggest setting calendar reminders to help you plan your day.

    ORDER ISSUES OR DISCREPANCIES

    If you have an issue or discrepancy with your order (i.e. did not receive order, missing/incorrect items, etc.) please contact us the same day of your delivery, so we can resolve the issue in a timely manner. You may contact us via email (latinhousekendall@gmail.com). If you do not contact us by end of day 8:00pm on your scheduled delivery date, unfortunately, we will not be able to correct the issue, credit or refund the account.

    CHANGES OR CANCELLATIONS TO YOUR ORDER

    If you wish to make any changes to your meals, you just do so by no later than Thursday noon (for the following week’s meal service). Any changes made after that are not guaranteed, but we will definitely try our best to accommodate.

    FOOD ALLERGIES & FOOD RELATED MEDICAL CONDITIONS

    If you have any life-threatening food allergies or medical conditions that are food related, we strongly recommend you discontinue service immediately. MadloveFit Meals, Foodgasm, LLC dba Latin House, will not assume any liability for adverse reactions to foods consumed. We do our best to avoid foods listed on your allergy list; however, since we do not do personalized meals we cannot guarantee that we will be able to avoid all allergies all the time and do not issue credits or refunds for foods received on the allergy list.

    REFUND POLICY

    You may receive 100% of your money back with proper notice within 24-hours of placing your order but not past Thursday NOON (for the following week’s meal service). Past this deadline, there can be no exceptions due to the advanced planning necessary for meal production and delivery scheduling. As a MadloveFit member, you are responsible for providing adequate notice for all account updates including, meal types, cancellations, allergies, and/or substitutions.
